1. Who We Are and Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the T-NOVA website and the NAATI certified translation services offered on it. Services are provided by TNOVA LLC, a Delaware limited liability company, trading as "T-NOVA" ("T-NOVA", "we", "us", "our"). Full company registration details (registered agent, formation number, EIN) will be updated upon incorporation. By requesting a quote, submitting documents, or paying for a translation, you ("client", "you") agree to these Terms and to our Privacy Policy.
2. Services
T-NOVA provides NAATI certified translation of documents for Australian visa, migration, and related purposes, across 60+ languages. Certified translations include the translator's full name, NAATI credential number, a certification statement, and signature.
3. Order Process
- You submit your documents through the quote form, by email, or by Telegram/WhatsApp.
- We review the documents and confirm your exact price, normally within 60 minutes. No work begins and no payment is taken at this stage.
- If you accept the quote, you pay the full price before translation work begins.
- A NAATI certified translator completes the translation, which is quality-checked before delivery.
- Your certified translation is delivered as a PDF by email.
4. Your Responsibilities
You confirm that you have the right to submit the documents you provide, and that they are legible and complete. Illegible, incomplete, or incorrect source documents may affect price, delivery time, or translation accuracy, and are your responsibility, not ours. If we need clarification from you, your response time may extend the delivery time stated in Section 6.
5. Pricing and Payment
All prices are quoted in Australian Dollars (AUD) and confirmed in writing before you pay. Payment is due in full before translation work begins. An express-service surcharge applies if you choose 24-hour turnaround instead of the 48-hour standard; both are stated at quote confirmation.
6. Delivery
Standard turnaround is 48 hours; Express turnaround is 24 hours, measured from the time we confirm your order and receive full payment. Delivery times may be extended by delays in your response to our questions, or by circumstances outside our reasonable control.
7. Acceptance Guarantee
Every translation is prepared to meet NAATI and Department of Home Affairs requirements. If a translation is rejected due to an error on our part, we correct it free of charge. Full terms, including timeframes and what isn't covered, are set out in our Refund & Cancellation Policy.
8. Ownership of Your Translation
Once paid in full, the completed translation is yours to use. We do not use the content of your documents for any purpose other than completing your order, per our Privacy Policy.
9. Confidentiality and Your Data
Your documents and personal data are handled as described in our Privacy Policy, including how long we retain them and your rights over your data.
10. Disclaimers and Limitation of Liability
We are not responsible for decisions made by the Department of Home Affairs, NAATI, or any other third-party body, including visa or application outcomes, except where a decision results directly from a confirmed error in our translation. To the maximum extent permitted by law, our total liability for any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses. Nothing in this section limits any liability that cannot lawfully be limited or excluded.
11. Prohibited Use
You may not submit fraudulent, falsified, or altered documents, or use our services for any unlawful purpose. We may refuse or cancel an order where we reasonably suspect this is happening, refunding any amount paid for work not yet started.
12. Right to Refuse or Cancel Service
We may decline, pause, or cancel an order at our discretion, including for suspected fraud or misuse. Where we cancel an order through no fault of yours, we refund any amount paid for work not yet completed.
13. Changes to These Terms
We may update these Terms from time to time. The current version always applies to new orders; changes do not affect an order already confirmed and paid for.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Before starting any formal proceeding, both parties agree to first try to resolve any dispute informally by contacting us at tnovatranslate@gmail.com. If a dispute can't be resolved informally within 30 days, either party may bring it before the state or federal courts located in Delaware. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right that cannot lawfully be excluded or limited under the law of your country of residence, including the Australian Consumer Law where it applies to you.
